The Arlington County Board of Zoning Appeals (BZA) is empowered to grant variances and relief from zoning requirements regulating the placement of buildings and/or structures on single-family residential lots. The BZA also hears appeals to the administrative decisions of the Zoning Administrator. There is a 5% Automation Enhancement Fee assessed on all filing fees.
For variance and BZA use permit requests seeking relief from more than one subsection of the zoning ordinance, there are additional fees assessed beyond the base filing fee. For example, a use permit request seeking relief from the required 25 ft. street setback and the required 25 ft. rear lot line setback requires relief from two subsections of the zoning ordinance (§3.2.6.A.1 and §3.2.6.A.2, respectively). Where as a use permit request seeking relief from the required 25 ft. rear lot line setback and the required 10 ft. side lot line setback only requires relief from one subsection of the zoning ordinance (§3.2.6.A.2, which regulates both side and rear setbacks).
Only the base fee is due at the time of filing. Any additional fees beyond the base fee will be determined following application review by the Board of Zoning Appeals Coordinator, and are due prior to advertising for the BZA hearing.

Variances are granted to provide relief from the zoning requirements regulating placement, bulk, height, and coverage of buildings and structures. Variances are also granted to allow construction on lots which do not conform to the minimum dimensional standards for the zoning district.

BZA Use Permits
BZA use permits allow modification of placement requirements (i.e. street or lot line setbacks) for single-family dwellings that are zoned R-20, R-10, R-8, R-6, R-5, or R2-7. Relief from height limits, lot coverage, and/or building footprint requirements cannot be granted under a BZA use permit, but instead must be obtained through a variance.
- Use Permit Fee to modify existing one-family dwellings: $350 plus $71 for each additional subsection
- Use Permit Fee for new one-family dwellings: $2,756 plus $551 per additional subsection
Appeals to the administrative decisions, determinations, and written orders of the Zoning Administrator pursuant to the zoning ordinance are heard and decided by the BZA. Per Code of Virginia §15.2-2311, any appeal must be filed within 30 days of the issuance of such decision.
